These Terms of Use ("Terms") govern your access to and use of Insight The Paddock's website, applications, software, and services (collectively, the "Services"). Insight The Paddock is operated by our team (collectively referred to as 'Insight The Paddock', 'we', 'our', or 'us').
By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our Services.
2. Eligibility
You must be at least 18 years old or have the consent of a legal guardian to use our Services.
If you use the Services on behalf of a company or entity, you confirm you have authority to bind that entity to these Terms.
The Services are intended solely for users who are at least 18 years old or the legal age of majority in their jurisdiction, whichever is higher. By accessing or using the Services, you represent and warrant that you meet this age requirement.
3. User License and Restrictions
We grant you a limited, personal, non-transferable, non-exclusive license to use our Services solely for your personal motorcycle track day optimization and community participation.
You may not
- Reuse, redistribute, sublicense, or exploit any Insight The Paddock-generated content commercially or publicly.
- Reverse engineer, copy, scrape, or create derivative works of our software or Services.
- Use the Services for unlawful, fraudulent, misleading, harassing, or abusive purposes.
- Upload data or content containing false, misleading, or offensive information.
- Share setup recommendations without proper attribution or for commercial gain.
We may suspend or terminate your account at any time, without notice, if you violate these Terms.
4. User Responsibility and Account Use
You are solely responsible for all activity under your account, even if done by someone else using your credentials.
We are not obligated to verify user identity at login. You are responsible for maintaining the security of your account credentials.
5. Setup Recommendations Disclaimer & User Responsibility
Insight The Paddock provides tools and community-driven recommendations to help you optimize your motorcycle setup for track days.
Important safety notice
By using these tools, you acknowledge and agree to the following:
- Setup recommendations may contain errors, inaccuracies, or may not be suitable for your specific motorcycle, riding style, or track conditions.
- Insight The Paddock does not vet, verify, or endorse any generated recommendations. We provide tools only; you are solely responsible for the final setup you use.
- You must not submit sensitive, confidential, or unlawful information unless it is necessary for setup optimization.
- To improve our Services, Insight The Paddock may collect and store inputs you provide, including setup data, performance logs, and community interactions.
- You remain fully liable for any consequences arising from the use or misuse of setup recommendations, including recommendations that you failed to verify or modify.
- Insight The Paddock disclaims all liability for any errors, omissions, or consequences resulting from the use of setup recommendations.
6. No Guarantee of Performance
Insight The Paddock provides tools and community features only. We do not guarantee improved lap times, better performance, enhanced safety, or any specific outcome from using the Services. Track performance depends on numerous factors including rider skill, track conditions, weather, and motorcycle condition.
6A. Paid Promotions & Boost Options (Trackdays and Listings)
Some parts of the Services include optional paid upgrades that increase the visibility of a trackday or listing on our platform (each a "Promotion" or "Boost"). Promotions do not guarantee views, clicks, sales, bookings, or any specific result. Placement and reach can vary based on user activity, timing, and other factors.
Trackday promotions
- Calendar placement: Optional tiers may pin your trackday at the top of our trackday calendar for a limited period and show a featured badge.
- Email boost: You may be able to send a promotional email about your trackday to registered users. Email boosts are limited (for example, once every 7 days per trackday) and can be disabled if the trackday is missing required information.
- Eligibility: Trackday promotions are only available for upcoming trackdays (not finished/expired events).
Marketplace and ticket listing boosts
- Boosted placement: Optional tiers may pin an active listing (marketplace items and/or trackday ticket listings) at the top of the relevant browse page for a limited number of days and show a featured badge.
- Eligibility: Boosts are only available for active listings.
Upgrades while active
Payments: Payments for Promotions may be processed by third-party payment providers (such as Stripe). We do not store your full payment card details. If payments are not available in your environment, Promotions may be unavailable or applied instantly in a limited test mode.
Refunds: Unless required by applicable law, Promotions are generally non-refundable once they have been delivered/activated (for example, once a listing has been featured/pinned or an email boost has started). If a Promotion fails to activate due to a technical issue on our side, contact support and we will investigate and, where appropriate, provide a remedy.
7. User-Submitted Data & Indemnification
We do not verify or fact-check user data, setup recommendations, or performance claims.
You are fully liable and agree to indemnify Insight The Paddock and our partners against any claims, damages, or losses arising from your use, data, or content.
8. Community Guidelines
Our platform includes community features such as forums, setup sharing, and track day discussions. When participating in these features:
Respectful Communication
Maintain respectful and constructive communication with other community members.
Accurate Information
Share accurate setup information and clearly indicate when recommendations are experimental or unverified.
Safety First
Always prioritize safety and encourage others to seek professional advice for critical setup changes.
9. Marketplace Seller Responsibility
Insight The Paddock provides a marketplace platform where users can list and sell motorcycle-related items, parts, and accessories. When you list an item for sale on our marketplace, you acknowledge and agree to the following:
Seller liability
Specifically, you are responsible for:
- Accurate Listings: Providing accurate, complete, and truthful descriptions of all items you list, including their condition, specifications, and any defects or limitations.
- Item Condition: Accurately representing the condition of items, including any damage, wear, or modifications.
- Pricing and Payment: Setting fair prices and fulfilling payment obligations as agreed with buyers.
- Delivery and Shipping: Properly packaging items, arranging delivery or pickup as specified, and ensuring items arrive in the condition described.
- Legal Compliance: Ensuring all items comply with applicable laws and regulations, and that you have the legal right to sell the items.
- Dispute Resolution: Resolving any disputes, complaints, or issues with buyers in good faith and in a timely manner.
- Refunds and Returns: Handling refunds, returns, or exchanges according to any terms you specify or as required by applicable consumer protection laws.
Insight The Paddock acts solely as a platform to facilitate connections between buyers and sellers. We are not a party to transactions between users and do not guarantee the quality, safety, legality, or accuracy of any listings. We are not responsible for any losses, damages, or disputes arising from marketplace transactions.
You agree to indemnify and hold Insight The Paddock harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the marketplace as a seller, including but not limited to inaccurate listings, defective items, or failure to complete transactions as agreed.
10. Acceptable Use Policy
You agree not to:
- Harass, impersonate, or defraud other users or track day organizers.
- Use Insight The Paddock for spamming, phishing, or distributing malware.
- Scrape, crawl, or mine data from our Services without permission.
- Circumvent or interfere with security or authentication features.
- Engage in unauthorized access or overburden our infrastructure.
- Share false or misleading information about track conditions, setups, or performance.
- Use the platform to promote unsafe riding practices or illegal activities.
We may report misuse to law enforcement and reserve the right to remove content that violates these guidelines.
11. Feedback & User Contributions
We welcome your feedback, suggestions, and any content you submit while using our Services.
By submitting any material — including feedback, ideas, setup recommendations, forum posts, or other content — you grant Insight The Paddock a worldwide, royalty-free, irrevocable, perpetual license to use, reproduce, modify, distribute, and adapt such material for the purpose of improving, operating, and promoting the Services.
- No Compensation Required — We are not obligated to compensate you or acknowledge your contributions.
- Content Rights — You retain ownership of your content, but we have the right to use it for system improvement and feature development.
- Compliance Required — Submitted content must comply with our Acceptable Use Policy and must not infringe on third-party rights.
12. Changes to Terms & Services
We may modify these Terms and the Services at any time without notice. Continued use after changes means you accept them. We will make reasonable efforts to notify users of significant changes through the platform or email.
13. Service Availability & Right to Discontinue
We may modify, suspend, or discontinue the Services at any time, without notice or liability. We strive to maintain high availability but cannot guarantee uninterrupted service.
14. Disclaimer of Warranties
All Services are provided "as is" and "as available," without warranties of any kind, including but not limited to:
- Merchantability, fitness for a particular purpose, non-infringement, accuracy, or uptime.
- We do not guarantee Services will be error-free, uninterrupted, or meet your needs.
- Setup recommendations are provided for informational purposes only and should not replace professional advice.
15. Limitation of Liability
To the fullest extent permitted by law:
- Our maximum liability is capped at the total fees you paid in the last 12 months (if any).
- We are not liable for indirect, incidental, punitive, or consequential damages.
- We are not liable for any injuries, damages, or losses resulting from the use of setup recommendations or track day participation.
- You assume all risks associated with motorcycle track riding and setup modifications.
16. Governing Law
These Terms are governed by the laws of the Netherlands. Any disputes arising from these Terms or your use of the Services will be resolved in the courts of the Netherlands.
17. Electronic Communications
By using our Services, you consent to receive notices and communications electronically (including via email or your account dashboard). These meet any legal requirements for written notices.
18. Third Party Services & Links
We are not responsible for third-party websites, services, or integrations, and disclaim all liability for their actions, content, or outcomes. This includes track day organizers, motorcycle manufacturers, and other service providers mentioned on our platform.
19. Ownership & Intellectual Property
All rights in our Services and content are owned by Insight The Paddock. Your use does not grant you any rights, title, or ownership. You may not use our trademarks, logos, or other intellectual property without written permission.
20. Severability & No Waiver
If any part of these Terms is invalid, the remainder will continue in effect. No failure to enforce our rights shall be deemed a waiver.
